By accessing or using PassRate ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Service.

• "We", "Us", "Our" — PassRate, the service provider
• "You", "Your" — the driving instructor or organisation using the Service
• "Pupil" — a learner driver whose data you manage through the Service
• "Subscription" — your paid access to the Service

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

PassRate operates on a subscription basis. Subscription fees are billed monthly in advance. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

Lesson payments between you and your pupils are processed through Stripe Connect. PassRate does not hold or process these funds. Standard Stripe processing fees apply.

You are the data controller for any pupil data you enter into the Service. You are responsible for obtaining appropriate consent from your pupils and complying with UK GDPR. Our handling of your data is governed by our Privacy Policy.

You agree not to:

• Use the Service for any unlawful purpose
• Share your account credentials with unauthorised users
• Attempt to gain unauthorised access to the Service or its systems
• Use the Service to send spam or unsolicited communications
• Upload malicious code or attempt to disrupt the Service

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may suspend access for maintenance, upgrades, or emergency repairs. We will make reasonable efforts to provide notice of planned maintenance.

PassRate is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the fees you have paid us in the 12 months preceding the claim.

PassRate provides tools for managing driving instruction. You remain solely responsible for the quality of instruction provided to your pupils and for ensuring your pupils are adequately prepared for their driving tests. PassRate does not guarantee test outcomes.

We may terminate or suspend your account if you breach these terms. Upon termination, your right to use the Service ceases immediately. We will provide you with a reasonable opportunity to export your data before deletion, subject to any legal requirements.

We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
